Your privacy is important to us. Accordingly, CHEETEYE, LLC, a Colorado limited liability company, and its affiliates and subsidiaries with its office located at 10084 East Kemper Road, STE 6, Loveland, OH 45140, USA (collectively “Cheeteye”, "us", "we", or "our") have developed a privacy policy that covers our use, collection, transfer and storage of your information. It also explains your rights in relation to your Personal Information (defined below) and how to contact us or supervisory authorities in the event you have a complaint or request. We collect, use, and are responsible for certain personal information about you. We may collect information from you in a variety of ways, including, but not limited to your use of (i) our social media posts and ads; (ii) contacting us; (iii) contact information collected in our marketing database; (iv) participating in an online survey; (v) data analytics providers; (vi) your continuing relationship with us; (vii) voluntarily providing information to us through other means such as contact box or otherwise; or (viii) your internet protocol (IP) address.
Personal Information we collect may include your: (i) name, (ii) mailing address; (iii) phone number; (iv) email address; (v) contact preferences; (vi) notes you share with us; (vii) the company you work for or are affiliated with; and (viii) any other information you share with us.
We will not collect sensitive personal information, such as a consumer’s social security number, driver’s license and passport numbers, account numbers and credentials, and other information included under the definition of sensitive personal information provided in the CCPA nor under the definition of special personal information provided in the POPIA.
We may also use and store information about your location if you give us permission to do so ("Location Data"). We use this data to provide features, to improve and customize our website. You can enable or disable location services when you use our website at any time by way of your device settings.
Our website, online services, and advertisements may use “cookies” and other technologies. These technologies are generally used to provide analytics regarding what other sites you have visited, products you have looked at, how you were directed to our site, how long you have visited each site or page and to possibly respond with banner ads. Without you providing certain Personal Information, and/or us being able to obtain it, we may be prevented from or limited in the performance of certain of our services.
II. Legal Basis for Processing Personal Information under the EU General Data Protection Regulation (GDPR) and the South African Protection of Personal Information Act, 2013 (POPIA)
If you are a resident of the EEA, or a resident or juristic person of South Africa, under certain data protection laws, Cheeteye’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Information we collect and the specific context in which we collect it. The right to object. You have the right to object to our processing of your Personal Information for direct marketing.
The right of restriction. You have the right to request that we restrict the processing of your Personal Information.
The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
The right to withdraw consent. You also have the right to withdraw your consent at any time where Cheeteye relied on your consent to process your Personal Information.

IV. Your Data Protection Rights under the POPIA
If protected under the POPIA, you have the right to have your Personal Information (as more particularly defined within) processed in accordance with the conditions for the lawful processing of Personal Information as referred to in the POPIA, including the following:
to be notified that—
personal information about you is being collected as provided for in terms of Section 18; or
your personal information has been accessed or acquired by an unauthorized person as provided for in terms of Section 22;
to establish whether a responsible party holds Personal Information of you and to request access to your Personal Information as provided for in terms of Section 23;
to request, where necessary, the correction, destruction or deletion of your personal information as provided for in terms of Section 24;
to object, on reasonable grounds relating to your situation to the processing of your Personal Information as provided for in terms of Section 11(3)(a);
to object to the processing of your Personal Information—
at any time for purposes of direct marketing in terms of Section 11(3)(b); or
in terms of Section 69(3)(c);
not to have your Personal Information processed for purposes of direct marketing by means of unsolicited electronic communications except as referred to in Section 69(1);
not to be subject, under certain circumstances, to a decision which is based solely on the basis of the automated processing of your Personal Information intended to provide a profile of you as provided for in terms of Section 71;
to submit a complaint to the Information Regulator regarding the alleged interference with the protection of your Personal Information as a data subject or to submit a complaint to the Information Regulator in respect of a determination of an adjudicator as provided for in terms of Section 74; and
to institute civil proceedings regarding the alleged interference with the protection of your personal information as provided for in Section 99.
V. California Consumers: Your Rights Under the CCPA/CPRA
If a California resident, you have the right under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and certain other privacy and data protection laws, as applicable, to exercise free of charge. Disclosure of Personal Information We Collect About You
You have the right to know, and request disclosure of:

Please note that we are not required to:
Retain any Personal Information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained,
Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information, or
Provide the Personal Information to you more than twice in a 12-month period.
Disclosure of Personal Information Sold, Shared, or Disclosed for a Business Purpose
In connection with any Personal Information we may sell, share, or disclose to a third party for a business purpose, you have the right to know:
The categories of personal information about you that we sold or shared and the categories of third parties to whom the personal information was sold or shared, and
The categories of personal information that we disclosed about you for a business purpose and the categories of persons to whom the personal information was disclosed for a business purpose
Right to Opt-Out of Selling or Sharing
You have the right to opt-out of the sale of your Personal Information or sharing of your Personal Information for the purpose of targeted behavioral advertising. Right to Deletion
Subject to certain exceptions by law, on receipt of a verifiable request from you, we will:

Direct third parties to whom the business has sold or shared your Personal Information to delete your personal information unless this proves impossible or involves disproportionate effort.

You have the right to not be retaliated against by us because you exercised any of your rights under the CCPA/CPRA. This means we cannot, among other things:
Deny goods or services to you,
Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties,
Provide a different level or quality of goods or services to you, or
Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
VI. Categories of Personal Information We Disclosed for a Business Purpose
In the preceding 12 months, we have disclosed for a business purpose to Service Providers that we use to help deliver our products and services to you and other third parties we use to help us run our business, the following categories of Personal Information:
Identifiers (e.g., a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name);
Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, their name, signature, address, telephone number, or employment;
Commercial information (e.g., records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);

VII. Categories of Information Sold to or Shared with Third Parties.
We have not sold or shared consumers' Personal Information with third parties for monetary purposes, nor beyond disclosure for a business purpose, in the preceding 12 months. VIII. Transfer of Data
Your information, including Personal Information, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
If you are located outside and choose to provide information to us, please note that we transfer the data, including Personal Information, to and process it there.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
Cheeteye will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information (POPIA: and the transfer is covered by Section 72(1)(b) consent to transfer, (c) transfer needed to perform a contract with the data subject or to take pre-concept steps, (d) transfer needed to conclude or perform a contract in the data subject’s interests, or (e) the transfer is for the data subject’s benefit and it’s not reasonably practicable to obtain the data subject’s consent).

Under certain circumstances, Cheeteye may be required to disclose your Personal Information if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

XIV. Children's Privacy
